I've noticed people are quite often asking questions relating to the MOT, usually because they've got pulled for something not right on their car. Moaning follows as someone will inevitably point out that the misdemeanour is either not a testable item or is not quantified. What's going on? How can the police just make stuff up to fine you for? The answer is that they don't.

Congratulations - you've probably fallen foul of the Road Vehicles (Construction & Use) Regulations 1986.

Most people thing the MOT is the be all and end all of roadworthiness - if it's not tested it's not important. Sadly they are wrong. Thanks to the Road Vehicles (Construction & Use) Regulations 1986 we operate under a two tier system which most people are fairly ignorant of and for reasons lost in the hazy mists of time one set of regulations does not necessarily tie in with the other.

To that end I've posted links to the relevant legislation. The VOSA MOT link is updated annually whilst proposed updates are included elsewhere in the site. The Road Vehicles (Construction & Use) Regulations 1986 link is to the Statutory Instrument in its original form. The second link is for all ammendments carried out to that legislation, unfortunately there is no other way to condense it down other than grafting through it all which I don't have time to do, sorry. Regardless, if you want to keep yourself legal I'd advise you to read both and know where you stand especially of you have iffy mods (just remember though, nobody likes a smartarse, much less a legally clued up smartarse so if you are pulled try not to gloat too much when you pull a copy of the relevant legislation out to your defence ;) ).

Nice post :thumbup:

It is a bit of a joke really, another case of expecting people to know the ins and outs of the law but not really making it clear. In the most part people won't fall foul of these regulations as they drive a run of the mill production car however in the modifying community its worth while knowing at least the broad strokes of the regulations effecting you.
